§ 14-25. Lake Chesdin, restrictions on recreational or other use.

  • (a)

    For the purposes of this section, "motorboat" shall mean any watercraft propelled in any way by machinery.

    (b)

    No person shall operate a motorboat on Lake Chesdin at a speed in excess of 45 miles per hour.

    (c)

    No person shall operate a motorboat that is equipped with a motor or engine that expels exhaust directly into the atmosphere on Lake Chesdin.

    (d)

    No person shall use Lake Chesdin for recreational or other purposes within a distance of 300 feet of the George F. Brasfield Dam.

    (e)

    No person shall use the George F. Brasfield Dam for recreational or other purposes.

    (f)

    Any person desiring to place "no wake" buoys along waterways in the county shall first obtain approval from the board of supervisors and the Virginia Department of Game and Inland Fisheries (the "department").

    (1)

    A completed "Application for Establishment of Regulatory Markers on Public Waters of Virginia," available from the department, shall be submitted to the board.

    (2)

    After notice and a public hearing, the board shall vote to approve or disapprove the application.

    (3)

    If the board approves the request, the application shall be forwarded to the department for final approval.

    (4)

    All markers approved by the board and authorized by the department shall be installed and maintained at no expense to the board or department and shall conform to the specifications, standards and conditions established by the department.

    (g)

    Any person who violates any provision of this section shall be guilty of a misdemeanor, punishable by a fine of not more than $50.00.

    (h)

    This section shall not apply to any person performing any official duty pertaining to the operation or maintenance of Lake Chesdin or the George F. Brasfield Dam, the enforcement of this section, or any law-enforcement or emergency rescue duties.
