§ 18-65. Extensions to serve developed areas.

  • (a)

    The county shall not pay for an extension of utility lines that serves areas that are already developed unless:

    (1)

    The board of supervisors has approved the extension as part of the utilities capital improvement program;

    (2)

    The board of supervisors has approved an extension to a residential area in which 70 percent of the homeowners requesting service have signed contracts agreeing to connect to the utility lines; or

    (3)

    The board of supervisors has approved a county contribution to an extension as part of a tax assessment or development district that is created pursuant to section 18-67.

    Before the board of supervisors approves any extension to serve a developed area, the health department shall certify that a significant portion of the homes in the area to be served have experienced well or septic system failure and that it is economically impractical to repair existing wells or septic systems.
