§ 18-115. Determination of character and concentration of waste.
(a)
The director shall make a periodic determination of the character and concentration of the industrial waste or pollutants that are discharged by a significant industrial user.
(b)
The significant industrial user shall provide sampling sites for the director to make the determination required by subsection (a). The location and design of sampling sites shall be approved by the director. The facilities sampling and monitoring equipment shall be maintained at all times in a safe and proper monitoring condition by the industrial user at its own expense. All devices used to measure wastewater flow and quality shall be calibrated as per manufacturer's recommendation to ensure accuracy.
(c)
The director shall collect samples of industrial waste or pollutants that are discharged into the sanitary sewer system. The samples shall be analyzed using laboratory methods that conform with 40 CFR 136, as amended.
(d)
The director's determination of the character and concentration of the industrial waste or pollutants that are discharged into the sanitary sewer system shall be based on the analysis that is performed in accordance with subsection (c) for the purposes of determining strong waste surcharges on significant industrial users.
(e)
The director may add to the surcharge the cost that the county incurs for sampling and analyzing waste or pollutants that are subject to surcharges in accordance with section 18-107.
