§ 2-95. Disposal of unclaimed firearms and other weapons.

  • (a)

    Whenever an unclaimed firearm or other weapon has been in the possession of the police department for more than 60 days, the chief of police may order the firearm or weapon be destroyed or rendered permanently inoperable.

    (b)

    For the purposes of this section, "unclaimed firearm or other weapon" shall have the same meaning as "unclaimed personal property," as defined in section 2-92.

    (c)

    Prior to ordering the destruction or alteration of a firearm or weapon, the chief of police shall (i) make reasonable attempts to notify the rightful owner of the firearm or weapon, (ii) obtain from the commonwealth's attorney a written statement advising that the firearm or weapon is not needed in any criminal prosecution, and (iii) give public notice once a week for two successive weeks in a newspaper of countywide circulation, that the firearm or weapon shall be destroyed or rendered permanently inoperable. The notice shall include a description of the firearm or weapon and the date, time and place of the destruction.
