§ 3-64. Same—Issuance or denial; revocation.

  • (a)

    The chief of police shall act on the application within 21 days of the filing of the application and shall not issue a permit unless (i) the requirements of this article have been met, and (ii) he determines that adequate crowd and traffic control can be provided for the parade or procession to protect the public health, safety and welfare. The chief of police may include restrictions or conditions in the permit as he deems advisable to protect the public health, safety and welfare. In addition, the chief of police may require the applicant to deposit with the police department a sum which the chief of police determines based on his estimate of the cost of additional county services which are necessitated by the parade or procession, including, but not limited to, additional police officers necessary for traffic or crowd control. Whether or not such deposit is required, the applicant shall be responsible for paying to the county the actual cost of such additional services.

    (b)

    The chief of police may either refuse to issue a permit or may require an applicant to modify or amend the application if the chief of police determines that adequate crowd and traffic control cannot be provided for the parade or procession. Each denial of an application and the reasons for such denial shall be in writing and mailed to the applicant at the address indicated in the application.

    (c)

    The chief of police may revoke any permit issued under this article for failure to comply with any of the provisions of this article or for failure to comply with any conditions or restrictions contained in the permit.
