§ 8-38. Penalties for violations of article.
(a)
Any person who knowingly violates any provision of this article shall be guilty of a class 1 misdemeanor. Each day that such violation is committed, and each day that such violation is permitted to remain uncorrected shall constitute a separate offense.
(b)
Any person who otherwise violates any provision of this article shall be subject to a civil penalty between $250.00 and $1,000.00 for each day that the violation continues. The court assessing such civil penalty may order the penalty to be paid into the treasury of the county and designated for the purpose of minimizing, preventing, managing or mitigating pollution of the waters of the county.
(c)
Any person who violates any provision of this article shall be responsible for testing, containing, cleaning up, abating, removing and disposing of any substance unlawfully discharged into the storm sewer system or into waters of the county, or, if the environmental engineer determines that correction of the violation can best be accomplished by the county, shall be liable to the county for all costs of testing, containment, cleanup, abatement, removal and disposal of any substance unlawfully discharged into the storm sewer system or into waters of the county.
