§ 3-48. Forfeiture of money, gambling devices, etc., seized from illegal gambling enterprises; innocent owners or lienors.

  • All money, gambling devices, office equipment and other personal property used in connection with an illegal gambling enterprise or activity, and all money, stakes and things of value received or proposed to be received by a winner in any illegal gambling transaction which are lawfully seized by a law enforcement officer or which lawfully come into his custody shall be forfeited to the county by order of the court in which a conviction under this article is obtained. The court shall order that money forfeited be paid to the county and shall order disposition of other property as it deems proper. If the court orders property sold, the proceeds of sale shall be paid to the county. Forfeiture under this article shall not extinguish the rights of any lawful property owner or person, firm or corporation with a perfected lien on property who did not know of the illegal use of his property.
