§ 9-248. Compliance with representation of petition.

  • The promises contained in the petition having provided the inducement for the board to create the CDA, compliance by the landowner with those promises is essential to the orderly development of the land contained in the CDA. Accordingly, the failure of the landowner or its successors in interest to perform any of the obligations or comply with any of the promises of the petition, including the exhibits to the petition, shall constitute a violation of county ordinance and until bonds have been issued pursuant to section 9-246 of this article, no building permits, other than the first 1,379 residential permits, shall be issued for any property located in the CDA while any such violation of this article continues. This provision shall not apply to permits for phase I of the conceptual plan for Lower Magnolia Green.
